Nasal Spray Lawsuit Nasal Gels And The Link To Smell Loss

There are lawsuits that are currently pending involving the use of certain Zicam cold remedy products. These lawsuits are alleging that there is a link between Smell Loss and Loss of Taste and the use of Zicam cold remedy swabs and nasal gel. These are over the counter cold products aimed at fighting the common cold.
For purposes of illustration, consider the following hypothetical. Jane Doe has been complaining of her inability to smell or taste for about a year. The problems started when normal smells became distorted and food started to taste funny. She made an appointment with her doctor. Janes doctor took a medical history from her to determine whether or not she had suffered from allergies or ever been diagnosed with a chronic nasal disease in the past. The doctor also wanted to rule out any infections or other abnormalities, so he ordered up a CT scan and an MRI. Jane also used a Scratch and Sniff test. Janes doctor diagnosed her with Anosmia, a condition that affects over 2 million Americans. Jane had never heard of this condition before and wanted more information. How was this going to impact her life? Her doctor decided to refer Jane to a dietary specialist to help with her any dietary modification. He also discussed the need for some lifestyle adjustments. Jane had a gas stove in her kitchen and she loved to cook for friends and family. With anosmia, she would be unable to smell a gas leak so she had to switch over to an electric appliance. She also needed to add more smoke detectors around the house as she would be unable to smell smoke if a fire broke out in her home.
Jane was watching the news when it was reported that the FDA sent a warning letter to Matrixx Initiatives Inc. and its subsidiary, Zicam LLC. The FDA also advised the public to stop using Zicam Cold Remedy Nasal Gel and Zicam Cold Remedy Swabs (this occurred on June 16, 2009). Jane had used a Zicam product last winter, and wondered if there was a connection. She contacted a Zicam Smell Loss Lawyer to discuss her rights. Jane had never filed a lawsuit before, and she was a little nervous. She didnt have a lot of money to hire a law firm. The attorney explained that his law firm was handling these cases on a contingency fee basis, which means there are no up front legal fees that Jane needs to come up with. If his law firm agreed to take the case, they would only get paid when the lawsuit was finished (only when a monetary recovery was made). Jane thought that this sounded like a fair bargain. She didnt need to come up with any money to hire the lawyer, and if the lawyer was successful and managed to get her compensation, she would pay him with part of the proceeds.
If you or a loved one have suffered from loss of taste or loss of smell and have used one of the Zicam products, you may have a claim. It is important for you to contact an attorney as soon as possible because you may run into time limits issues (statute of limitations) that can affect your ability to make a claim.
